Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Store Backup application for BigCommerce (the "Service"), operated by Store Backup & Restore ("Store Backup", "we", "us"). By installing or using the Service, you agree to these Terms. If you do not agree, do not install or use the Service.
The service
Store Backup creates versioned backups of your BigCommerce store data and lets you restore items to a previous version. Backups run automatically on a schedule and in real time via webhooks. Restores overwrite current data with the backed-up version; before each restore, we save a copy of the current state so the restore can be undone. Existing orders are never changed; a deleted order is only written back if you choose to restore it, and is recreated as a new order.
Free trial and subscriptions
- New installs include a 7-day free trial.
- After the trial, continued use requires a paid subscription. Plans are billed monthly and are based on your store's monthly order volume; your tier is determined automatically.
- Payments are processed by Stripe. By subscribing, you authorize recurring charges until you cancel.
- You can cancel at any time by uninstalling the app. Cancellation stops future charges; fees already paid are non-refundable except where required by law.
- If your trial ends or your subscription lapses, backups and restores are paused until you subscribe. Backups already stored are retained for your plan's retention period.
Your responsibilities
- You are responsible for maintaining the security of your BigCommerce account and for the actions taken within the Service by your store's users.
- You agree to use the Service only for lawful purposes and not to misuse, disrupt, or attempt to gain unauthorized access to it.
- A restore overwrites current data. You are responsible for confirming what you restore.
Availability and accuracy of backups
We work hard to back up your data reliably, but the Service depends on the availability and limits of the BigCommerce API and third-party providers. We do not warrant that backups will be complete, uninterrupted, or error-free, and the Service is not a substitute for your own record-keeping. You are responsible for verifying that critical data has been backed up.
Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, Store Backup and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three (3) months preceding the event giving rise to the claim.
Termination
You may stop using the Service at any time by uninstalling the app. We may suspend or terminate access if you breach these Terms or to comply with the law. On termination, the store's stored backups are removed as described in our Privacy Policy.
Changes to the service and these terms
We may update the Service and these Terms over time. For material changes to these Terms, we will revise the "Last updated" date above and provide notice through the app or by email. Continued use after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of USA, without regard to its conflict-of-laws rules. Any dispute will be subject to the courts located in CA, San Francisco.
